Effective date: October 15, 2026
1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and BeerPass ("MyBeerPass", "we", "us" or "our"), United States. They govern your use of the MyBeerPass mobile app, website and related services (together, the "Service").
By creating an account, buying a membership or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
PLEASE READ SECTION 2 (AGE REQUIREMENTS) AND SECTION 4 (AUTOMATIC RENEWAL) CAREFULLY.
2. Age requirements (18+ and 21+)
- You must be at least 18 years old to download, register for or use the Service. If you are under 18, you may not use the Service.
- You must be at least 21 years old to redeem any offer that includes an alcoholic beverage. Twenty-one is the minimum legal drinking age in every US state.
- If you are 18 to 20 years old, you may create an account and browse breweries and offers. You may not redeem alcoholic offers. Most membership benefits are alcoholic drinks, so you should not buy a membership unless you are 21 or older.
- By registering, you confirm that you meet these age requirements. We may ask for proof of age at any time. We may suspend or close any account we reasonably believe belongs to someone who does not meet these requirements.
- Participating breweries will check a valid government-issued photo ID before serving alcohol. Your MyBeerPass account, membership or QR code is not proof of age. A brewery may refuse service if you cannot show valid ID. We are not required to give a refund in that case.
- You must never let anyone else use your account or redeem your offers, especially anyone under 21. Buying or providing alcohol for a person under 21 is a crime in every US state.
3. Your account
- You must give accurate and complete information when you register (name, email address, phone number and address) and keep it up to date.
- We verify your email address with a one-time passcode. You must have access to the email address you register with.
- Keep your password confidential. You are responsible for all activity on your account.
- Each account is for one person only. Accounts and memberships are personal and cannot be sold, shared or transferred.
- Tell us right away at info@beerpassapp.com if you think someone has used your account without permission.
4. Memberships and automatic renewal
- A membership gives you access to drink offers at participating breweries for a set period. Plans may be daily, weekly, monthly or yearly. The price, billing period and benefits are shown in the app before you pay.
- AUTOMATIC RENEWAL: Your membership renews automatically at the end of each billing period for the same length of time. We charge the then-current price to your saved payment method until you cancel.
- How to cancel: you can cancel at any time in the app's subscription settings, or by emailing info@beerpassapp.com. Cancellation takes effect at the end of your current billing period. You keep your benefits until then, and you will not be charged again.
- You can restart a cancelled membership before the end of the billing period, or buy a new one later.
- Changing plans: you can switch plans in the app. Any price difference or credit is shown before you confirm the change.
- Price changes: we will tell you about any price increase at least [30] days before it applies to your next renewal. If you do not agree, you can cancel before the new price takes effect.
5. Payments
- Payments are processed by Stripe, Inc. ("Stripe"). Your card details are collected and stored by Stripe, not by us. Stripe's own terms and privacy policy also apply.
- All prices are in US dollars and include or exclude sales tax as shown at checkout.
- You authorize us, through Stripe, to charge your payment method for each membership period until you cancel. You can update your card in the app.
- If a payment fails, we may try again and may pause your membership benefits until the payment succeeds.
6. Refunds
- Except where the law requires otherwise, payments are non-refundable. This includes partly used billing periods and offers you did not redeem.
- If you think you were charged by mistake, contact info@beerpassapp.com within 30 days of the charge and we will look into it.
- If we end the Service or close your account without cause, we will refund the unused part of any prepaid membership.
7. Offers and how to redeem them
- Participating breweries, taprooms and venues ("Venues") are independent businesses. Each Venue sets its own offers. An offer states the drink, the number of drinks, and how often you can redeem it (for example once only, daily, weekly, monthly or yearly).
- You redeem an offer in person at the Venue, during its opening hours, by scanning the Venue's QR code in the app or as staff direct. A redemption is recorded as soon as it is made and cannot be undone.
- Offers are personal to you. They have no cash value and cannot be exchanged for cash, transferred, resold or combined with other promotions unless the offer says so. Unused offers do not carry over to the next period.
- Venues, offers and opening hours can change, be paused or end at any time. We do not promise that any particular Venue or offer will stay available.
- Redeeming an offer when you are not at the Venue, sharing or reusing QR codes or screenshots, using several accounts, or any other attempt to get more than your allowance is fraud. We may cancel your membership without a refund and close your account.
8. Venues and service of alcohol
- Each Venue sells and serves its own drinks and is responsible for holding its licenses and following alcohol laws. MyBeerPass does not sell, serve or deliver alcohol.
- A Venue may refuse to serve you at its discretion, including if you cannot show valid ID, appear intoxicated, or break its house rules. You must follow each Venue's rules while on its premises.
- Questions about the quality of a drink or your experience at a Venue should first be raised with that Venue. You can also tell us at info@beerpassapp.com.
9. Responsible drinking
- Drink responsibly and know your limits. Our offers are not an invitation to drink to excess.
- Never drink and drive. Plan a safe way home before you go out.
- Do not drink alcohol if you are pregnant, taking medication that interacts with alcohol, or have been advised not to drink.
- If you or someone you know needs help with alcohol, the SAMHSA National Helpline is free, confidential and open 24/7 at 1-800-662-4357.
10. Ratings and reviews
- You can rate and review Venues. Your reviews must be honest, based on your own visit, and lawful. They must not be offensive, misleading, or promote underage or excessive drinking.
- You keep ownership of what you post. You give us a worldwide, royalty-free license to use, display and share it in connection with the Service.
- We may remove any review that breaks these Terms.
11. Acceptable use
You agree not to:
- break any law, including alcohol and age laws, while using the Service;
- give false information, impersonate anyone, or create more than one account;
- copy, alter, reverse-engineer or resell the app or any part of the Service;
- interfere with the Service, its security or its servers, or use bots or scrapers;
- misuse offers, QR codes or payments, as described in section 7.
12. Our intellectual property
The app, website, MyBeerPass name and logo, and all related content belong to us or our licensors. We give you a limited, personal, non-transferable license to use the app for its intended purpose while you follow these Terms. Venue names and logos belong to the Venues.
13. Third-party services
The Service uses third-party services, including Stripe for payments and Google Maps for maps and directions. The app may also link to Venue websites. We are not responsible for third-party services or websites, and their own terms apply.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted or error-free, or that any Venue will honor an offer. We are not responsible for the drinks, premises, conduct or service of any Venue.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS OR DATA. THIS INCLUDES ANY HARM ARISING FROM YOUR CONSUMPTION OF ALCOHOL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100. Some states do not allow these limits, so some of them may not apply to you.
16. Indemnity
You agree to defend and indemnify MyBeerPass and its officers, employees and partners against claims, losses and costs that arise from your breach of these Terms, your misuse of the Service, or your conduct at any Venue.
17. Suspension, termination and deleting your account
- You can stop using the Service at any time. To delete your account, contact info@beerpassapp.com or use the delete option in the app if one is available. Deleting your account does not cancel a membership automatically, so cancel it first.
- We may suspend or close your account if you break these Terms, commit fraud, do not meet the age requirements, or if we must for legal reasons.
- Sections 6, 10, and 12 to 19 continue to apply after your account ends.
18. Changes to the Service and these Terms
We may update the Service and these Terms from time to time. If we make material changes, we will notify you in the app or by email at least [14] days before they take effect. If you keep using the Service after that, you accept the new Terms.
19. Governing law and disputes
- These Terms are governed by the laws of the State of [State] and applicable US federal law, without regard to conflict-of-law rules.
- Before starting any legal claim, please contact us at info@beerpassapp.com so we can try to resolve the issue informally within 30 days.
- Any dispute not resolved informally will be heard in the state or federal courts located in [County], [State]. Either party may instead bring an individual claim in small claims court.
